These Terms and Conditions apply to the use of the Quote Assist website and services.
Quote Assist is operated by NM Engineering Solutions Pty Ltd. ABN: 91 655 267 511.
Quote Assist operates from Victoria, Australia and provides online quote review services to clients across Australia.
By using this website, submitting an enquiry, uploading documents, requesting a quote review, accepting a quote, making payment, receiving a report or using our services, you agree to these Terms and Conditions, our Privacy Policy and our Disclaimer.
If you do not agree, you must not use the website or services.
1. Operator
Quote Assist is operated by NM Engineering Solutions Pty Ltd. ABN: 91 655 267 511.
In these Terms:
"Quote Assist", "we", "us" and "our" refer to NM Engineering Solutions Pty Ltd trading as Quote Assist.
"You", "your" and "customer" refer to the person, business or organisation using the website, submitting documents, requesting a review, receiving a report or purchasing a service.
2. About Quote Assist
Quote Assist provides online quote review, document review and decision-support services.
Our services are designed to help customers better understand quotes, estimates, proposals, inclusions, exclusions, assumptions, pricing structure, scope wording, supplier questions, potential risks and possible areas requiring clarification before making a purchasing decision.
Our services are based on the documents and information provided by the customer.
3. Acceptance of Terms
You agree to these Terms when you:
- access or use the website;
- submit an enquiry;
- upload documents;
- request a quote review;
- accept a service proposal;
- make payment;
- receive a report, summary or review from us; or
- otherwise communicate with us in relation to a service.
You also agree to our Privacy Policy and Disclaimer.
4. Scope of service
Unless otherwise agreed in writing, our services may include:
- quote review;
- document review;
- scope clarity review;
- identification of possible missing information;
- identification of possible exclusions, assumptions or unclear wording;
- comparison of quotes where included in the selected package;
- identification of possible risks or questions;
- preparation of suggested supplier questions;
- written decision-support summaries;
- general observations about value, completeness or clarity; and
- other related document-based review services.
The exact scope of the service depends on the package selected, the documents provided, the information available and anything separately agreed in writing.
5. Service limitations
Quote Assist provides document-based review and decision-support only.
We do not make the final decision for you.
We do not approve, certify, endorse, guarantee or recommend any supplier, contractor, builder, installer, tradesperson, product, system, design, project, quote or purchase.
We do not guarantee that a quote is fair, complete, compliant, accurate, safe, suitable, defect-free or the best available option.
Our review is not a substitute for advice from an appropriately qualified or licensed professional.
6. Not licensed advice
Unless expressly stated otherwise in writing, Quote Assist does not provide:
- legal advice;
- financial advice;
- taxation advice;
- insurance advice;
- building advice;
- architectural advice;
- engineering advice;
- engineering certification;
- electrical advice;
- mechanical advice;
- plumbing advice;
- solar installation advice;
- battery installation advice;
- quantity surveying advice;
- property inspection services;
- building inspection services;
- pest inspection services;
- valuation services;
- design certification;
- compliance certification;
- safety certification; or
- any other regulated or licensed professional advice.
If your decision requires licensed, technical, legal, financial, insurance, building, engineering, inspection, safety or compliance advice, you must seek advice from an appropriately qualified professional.
7. No physical inspection
Unless expressly agreed in writing, our services are document-based only.
We do not physically inspect:
- properties;
- homes;
- buildings;
- worksites;
- renovations;
- solar systems;
- battery systems;
- electrical installations;
- plumbing works;
- mechanical systems;
- products;
- materials;
- supplier workmanship; or
- any physical goods or site conditions.
Because we do not physically inspect the subject matter of a quote, our review may not identify defects, safety issues, compliance issues, site-specific risks, installation issues, workmanship issues, hidden conditions or other matters that could only be identified through inspection or specialist assessment.
8. No supplier endorsement
Any comments we make about a quote, supplier, contractor, product, service or proposal are based only on the documents and information provided to us.
We do not endorse, approve, certify or guarantee any supplier.
You remain responsible for conducting your own checks, including licences, insurance, reviews, references, qualifications, warranty terms, contract terms and suitability.
9. No guarantees
To the maximum extent permitted by law, we do not guarantee:
- supplier performance;
- workmanship;
- quote accuracy;
- price accuracy;
- market value;
- legal compliance;
- regulatory compliance;
- technical compliance;
- safety;
- savings;
- negotiation outcomes;
- dispute avoidance;
- refund outcomes;
- defect detection;
- hidden cost detection;
- all exclusions being identified;
- all risks being identified;
- future costs;
- project outcomes;
- installation outcomes;
- delivery timeframes;
- supplier reliability;
- product suitability;
- quote completeness;
- contract fairness; or
- that a particular quote, supplier or purchase is the best available option.
Our service is intended to help you ask better questions and make a more informed decision. It does not remove all risk from a purchase, supplier, contract or project.
10. Customer responsibility
You are responsible for:
- deciding whether to proceed with a quote, supplier or purchase;
- reviewing all supplier documents, contracts, warranties and terms;
- asking suppliers questions before committing;
- seeking licensed or specialist advice where needed;
- checking supplier licences, qualifications, insurance and reputation;
- confirming all inclusions, exclusions, assumptions, timeframes and payment terms with the supplier;
- ensuring your uploaded documents are accurate and complete;
- removing unnecessary sensitive information before upload;
- ensuring you have permission to upload and share documents with us; and
- making your own final decision.
11. Customer documents and uploaded information
You confirm that you have the right, authority or permission to upload, submit and share any documents or information you provide to us.
You must not upload documents that you are not authorised to share.
You must not upload unlawful, malicious, misleading, confidential third-party information without authority, or irrelevant sensitive material.
You should remove or redact unnecessary sensitive information before uploading documents.
Uploaded quote documents may contain personal information, addresses, supplier details, photos, invoice numbers, property details or other information. Our handling of personal information is explained in our Privacy Policy.
12. Accuracy and completeness of information
Our review depends on the documents and information you provide.
If documents are incomplete, inaccurate, outdated, unclear, misleading, poor quality or missing important information, our report, comments or recommendations may also be incomplete, inaccurate or limited.
We are not responsible for errors or omissions caused by incomplete, inaccurate or misleading information provided to us.
13. Packages and inclusions
We may offer different service packages, such as Essential Quote Review, Comparison Pack and Premium Decision Pack.
Each package has different inclusions, limitations, turnaround expectations and pricing.
Package descriptions on the website are general summaries only. The final scope of work will be based on the package selected and any written agreement between you and us.
We may decline, limit or re-price a review if the documents are unusually complex, unclear, extensive, urgent, technical or outside the intended scope of the selected package.
14. Pricing
Published prices are starting prices only unless expressly stated otherwise.
Final pricing may depend on:
- the number of quotes;
- number of documents;
- document length;
- complexity;
- urgency;
- industry or purchase type;
- requested turnaround;
- level of review required;
- whether comparison is required;
- whether follow-up review is included; and
- whether the matter falls outside standard package scope.
We will confirm pricing before work starts.
15. Payment
Payment is required before work starts unless otherwise agreed in writing.
We may issue invoices or use third-party payment providers.
We are not required to begin work until payment has been received or confirmed.
If payment is reversed, disputed, charged back or not received, we may suspend or cancel the service and recover any reasonable costs incurred, subject to applicable law.
16. Payment methods
We may accept payment by bank transfer, invoice, credit card, debit card, Stripe, PayPal or other payment methods made available from time to time.
Payment providers may have their own terms, fees, processing times and privacy practices.
Do not send bank card details by email or through upload forms.
17. GST
Unless otherwise stated, prices are in Australian dollars.
Where GST applies, pricing will be treated in accordance with applicable Australian tax requirements.
Invoices will identify GST treatment where required.
18. Refunds and cancellations
Because Quote Assist provides document review and decision-support services, refunds are generally not available once work has started, except where required by law.
Before work starts, you may request cancellation. If we agree that work has not commenced, we may provide a refund less any unrecoverable payment processing, administration or third-party costs, where permitted by law.
After work has started, we may decline a refund or provide a partial refund at our discretion, having regard to the work already performed, time spent, costs incurred and the circumstances of the request.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
19. Australian Consumer Law
Our services may come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify any rights, guarantees or remedies that you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Where we are permitted to limit our liability under the Australian Consumer Law, our liability is limited, at our option, to:
- supplying the services again; or
- paying the cost of having the services supplied again.
This clause applies only to the extent permitted by law.
20. Turnaround times
Any turnaround times stated on the website or in communications are estimates only unless expressly agreed in writing.
Turnaround times may depend on:
- document quality;
- document complexity;
- number of documents;
- whether further information is required;
- customer response times;
- payment confirmation;
- workload;
- public holidays;
- supplier document complexity; and
- technical issues.
We are not responsible for loss caused by customer delay, late document submission, incomplete information, urgent decision deadlines or supplier-imposed timeframes.
21. Reports and review outputs
Reports, summaries, comments, checklists, supplier questions or other outputs are prepared for the customer's personal or internal business decision-support use only.
Reports are based on the documents and information provided at the time of review.
Reports are not:
- legal advice;
- financial advice;
- insurance advice;
- building advice;
- engineering advice;
- certification;
- inspection reports;
- valuation reports;
- compliance reports;
- supplier endorsements;
- defect reports; or
- guarantees of outcome.
You must not represent our report as certification, approval, professional inspection, legal advice, engineering advice or supplier endorsement.
22. Supplier communication
Unless separately agreed in writing, Quote Assist does not contact suppliers, contractors, builders, installers, tradespeople or third parties on your behalf.
We generally provide suggested questions for you to ask the supplier directly.
If supplier communication is separately agreed, the scope, fee, method and limitations must be confirmed in writing before it occurs.
23. Follow-up review
Follow-up review of supplier responses is only included if expressly stated in the selected package or agreed in writing.
If follow-up review is not included, it may be available for an additional fee.
Follow-up review is also document-based and subject to the same limitations as the original service.
24. Confidentiality
We treat customer documents and information as confidential, subject to these Terms, our Privacy Policy, use of trusted third-party service providers and any legal obligations.
We may disclose information where necessary to:
- provide the service;
- operate the website;
- process payments;
- store documents;
- obtain professional advice;
- comply with law;
- respond to disputes, complaints, chargebacks or legal claims;
- protect our rights; or
- use service providers such as hosting, email, forms, file storage, analytics, payment processing or security providers.
25. Privacy
Our handling of personal information is set out in our Privacy Policy.
By using the website or services, you consent to the collection, use, storage and disclosure of personal information as described in the Privacy Policy.
26. Intellectual property
All website content, templates, reports, summaries, checklists, processes, wording, branding, layout, documents and materials created by Quote Assist remain the intellectual property of NM Engineering Solutions Pty Ltd or its licensors.
Subject to full payment, we grant you a limited, non-exclusive, non-transferable licence to use the report or review output for your personal or internal business decision-support purposes.
You must not copy, resell, republish, modify, distribute, commercially exploit or represent our materials as your own without written permission.
You must not use our reports as certification, approval, inspection, expert determination, legal advice or professional endorsement.
27. Website use
You must not:
- misuse the website;
- attempt unauthorised access;
- upload viruses, malware or malicious files;
- interfere with website security;
- scrape, copy or reproduce website content without permission;
- submit false, misleading or unlawful material;
- impersonate another person;
- upload documents without authority;
- use the website for unlawful purposes; or
- interfere with the operation of the website or services.
We may suspend or refuse access to the website or services if we reasonably believe these Terms have been breached.
28. Third-party links and providers
The website may contain links to third-party websites, tools, payment providers or services.
We are not responsible for the content, security, accuracy, availability, privacy practices or terms of third-party websites or providers.
Use of third-party services may be subject to their own terms and policies.
29. Reviews, testimonials and feedback
If you provide a review, testimonial, comment or feedback, you permit us to use it for marketing, website, social media or business purposes, unless you tell us otherwise in writing.
We may edit testimonials for length, spelling or clarity, provided the meaning is not materially changed.
We will not knowingly publish false or misleading testimonials.
30. Refusal of service
We may refuse, suspend or cancel a service where we reasonably consider that:
- the request is outside our service scope;
- the documents are unsuitable, incomplete or excessive;
- the request requires licensed or specialist advice we do not provide;
- the customer has not paid;
- the customer is abusive, threatening or unreasonable;
- the request creates a legal, ethical, safety or confidentiality concern;
- the request involves unlawful material;
- the customer has breached these Terms; or
- we are otherwise unable to provide the service.
If we cancel a service before work starts, we will generally provide a refund of amounts paid for that service, less any unrecoverable processing or third-party costs where permitted by law.
31. Disclaimers
To the maximum extent permitted by law, all services are provided on an "as is" and "as available" basis.
We make no representation or warranty that the website will be uninterrupted, error-free, secure or free from viruses or other harmful components.
We make no representation or warranty that our review will identify every risk, issue, missing detail, exclusion, hidden cost, supplier concern or contractual problem.
Nothing in this clause limits rights that cannot lawfully be excluded.
32. Limitation of liability
To the maximum extent permitted by law, NM Engineering Solutions Pty Ltd, trading as Quote Assist, is not liable for any indirect, consequential, special or economic loss, including loss of profit, loss of opportunity, loss of savings, loss of bargain, project delay, supplier dispute, increased project cost, business interruption, reputational damage or loss arising from reliance on our services.
To the maximum extent permitted by law, our total liability for any claim connected with the website, services, reports or these Terms is limited to the amount paid by you for the specific service giving rise to the claim.
Nothing in these Terms excludes, restricts or modifies any liability that cannot lawfully be excluded, restricted or modified.
33. Indemnity
You agree to indemnify NM Engineering Solutions Pty Ltd, Quote Assist and their officers, employees, contractors and agents from and against any loss, damage, claim, liability, cost or expense arising from:
- your breach of these Terms;
- your misuse of the website or services;
- documents or information you provide;
- your lack of authority to upload or share documents;
- your unlawful conduct;
- your reliance on the service contrary to these Terms;
- your communication with suppliers; or
- your final purchasing decision.
This indemnity does not apply to the extent the loss is caused by our negligence, breach of law or breach of these Terms.
34. Force majeure
We are not liable for delay or failure to perform services caused by events beyond our reasonable control, including internet outages, cyber incidents, service provider outages, power failures, natural disasters, illness, government action, industrial action, payment provider issues or other events outside our reasonable control.
35. Changes to services and Terms
We may update, change, suspend or discontinue any part of the website, services, pricing, packages or these Terms from time to time.
The version of the Terms published on the website at the time you request or purchase a service will generally apply to that service, unless otherwise agreed or required by law.
36. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or severed to the extent necessary, and the remaining parts will continue to apply.
37. Entire agreement
These Terms, together with the Privacy Policy, Disclaimer, any written service description and any invoice or written quote issued by us, form the agreement between you and us in relation to the service.
38. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
